Welcome to the StethoMe U.S. website (the "Site"), located at us.stethome.com. By accessing or using the Site, you agree to these Terms of Use ("Terms"). If you do not agree, please do not use the Site.
2. About This Site
The Site is currently a pre-launch marketing and early-access page for StethoMe's U.S. offering. At this stage, the Site does not process orders, payments, or accounts, and StethoMe's U.S. device and app are not yet available for purchase. Visitors can join an early-access waitlist or send us a message through the Site's contact form. As StethoMe's U.S. launch progresses, the Site's functionality — and these Terms — may change; see Section 12.
3. Intellectual Property
The Site and its content — including text, graphics, logos, images, and software — are owned by StethoMe or its licensors and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Site for your own personal, non-commercial purposes.
You may not copy, reproduce, distribute, scrape, reverse engineer, or create derivative works from the Site or its content, or use StethoMe's name, logos, or trademarks, without our prior written permission.
4. Acceptable Use
When using the Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Submit false or misleading information through the waitlist or contact forms;
- Attempt to interfere with, disrupt, or gain unauthorized access to the Site or its underlying systems;
- Introduce viruses, malware, or other harmful code to the Site; or
- Use any automated means (such as bots or scrapers) to access the Site without our permission.
We may suspend or restrict access to the Site for anyone who violates these Terms.
5. Health & AI Disclaimer
StethoMe is designed to help you support a healthy lifestyle, including living well if you manage an ongoing condition that affects your breathing. It tracks how your sessions compare to typical, healthy breathing patterns. StethoMe is not intended to diagnose, treat, cure, monitor, or prevent any medical condition or illness, and the AI report is not a substitute for care from your doctor or another qualified healthcare professional. Please don't make changes to your medication, nutrition, or exercise routine without first consulting a healthcare professional.
Nothing on this Site constitutes medical advice, and the Site itself does not provide diagnosis, treatment recommendations, or clinical guidance. Any content on the Site describing StethoMe's product or technology is provided for general informational purposes only.
6. No Warranties
The Site is provided "as is" and "as available," without warranties of any kind, whether express or implied. StethoMe does not guarantee that the Site will be uninterrupted, secure, or error-free, that any content on the Site is complete or accurate, or that any product, feature, or launch timing described on the Site will become available as, or when, described.
7. Limitation of Liability
To the fullest extent permitted by law, StethoMe will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or related to your use of the Site, even if StethoMe has been advised of the possibility of such damages.

You agree to indemnify and hold StethoMe, its officers, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Site.
9. Third-Party Links & Services
The Site is built on Shopify and may contain links to third-party websites or services, including social media platforms. These links are provided for your convenience only. StethoMe does not control and is not responsible for the content, privacy practices, or terms of any third-party site, and linking to a third-party site does not imply StethoMe's endorsement of it.

Our collection and use of personal information through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand our practices.
11. Governing Law & Disputes
These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-laws principles, reflecting that the Site is currently operated by StethoMe sp. z o.o., a Polish entity. Any dispute arising out of or relating to these Terms or your use of the Site will be resolved exclusively in the courts having jurisdiction over StethoMe sp. z o.o.'s registered seat in Poznań, Poland, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may update these Terms from time to time as the Site and StethoMe's U.S. offering evolve. If we do, we'll post the updated version here with a new "Last updated" date.
